What Construction Quote is
Construction Quote gives a contractor a private link. The contractor sends that link to their own customer by text, email, or a button on their own website. The customer opens it on a phone, films the job, and sends the video along with their name, address, phone number, email address and how soon they need the work. It arrives with that one contractor, privately.
That is the whole product. We carry a message between two people who already found each other. We are not a marketplace, we do not run an auction, and we do not sell leads. We do not do construction work, we do not inspect it, and we do not price it.
The service is operated from Winnipeg, Manitoba, Canada. By using it you agree to these terms. If you do not agree with them, do not use it.
We do not promise a reply or a quote
Sending a video does not create an agreement with a contractor and does not oblige them to answer, to visit, to quote, or to take the job. Whether they get back to you, how fast, and what they say is entirely up to them.
If a contractor has set a reply window on their link, that is their own statement about how they work. It is not a promise from us, and we do not enforce it.
We also do not promise that the service will be available without interruption. We may need to take it down for maintenance or because something has broken.
The contractor is responsible for their own work
Every quote, price, deposit, schedule, licence, insurance policy, warranty and piece of workmanship belongs to the contractor. We do not check their credentials, we do not verify their prices, and we are not a party to the agreement you make with them.
If something goes wrong with the job, take it up with the contractor. If they never reply, contact them directly. We can tell you that your video was delivered. We cannot make anyone act on it.
Using it properly
Whether you are a contractor or a customer, do not use Construction Quote to:
- Film a person who has not agreed to be filmed, or record anywhere you do not have permission to be.
- Send someone else's personal information as if it were your own.
- Send anything unlawful, threatening, harassing, or sexual.
- Send a request you have no genuine intention of following up, or send bulk or automated requests.
- Attempt to reach requests that are not yours, probe the service for weaknesses, or interfere with how it runs for anyone else.
- Resell access, or use the service to build a competing lead list.
We can suspend or close an account, or disable a link, if it is being used this way. If a contractor’s link is disabled, their customers see a plain message saying the link is not working and are told to contact the business directly, rather than filming a video that goes nowhere.
Your video and your information
The video you send stays yours. You give us permission to store it and to show it to the one contractor you sent it to, which is the only thing we do with it. We do not use it in advertising, we do not show it to anyone else, and we do not sell it.
What we collect, where it is kept, how long we keep it and how to have it deleted are set out in the privacy policy, which forms part of these terms.
Contractors: the requests that arrive on your link contain a real person’s home address and video of the inside of their home. Use them to quote and carry out the job they asked about, and nothing else. Do not add these people to a marketing list, sell their details, or pass them to another business.
Trials, pricing and billing
A new account starts on a 14 day free trial. We do not ask for a card to start it.
Billing is not switched on. There is no payment processing in the product today, no price has been set, and nothing can be charged to you. We are not going to write terms for a payment system that does not exist yet.
Before we charge anyone for anything, we will tell you the price, publish billing terms here, and give you the chance to decide. Nothing will start charging automatically at the end of your trial.
After a trial ends, an account may stop accepting new requests. If that happens, the customer opening the link is told the business is not taking requests right now rather than being left with a form that fails.
Ending it
You can stop using Construction Quote at any time, and you can ask us to close your account and delete your data by emailing info@davidperron.ca.
We can suspend or close an account that breaks these terms. Where it is reasonable to do so, we will tell you why first.
The service is still early. We may change how it works, add things, or take things away. If we discontinue it, we will give notice by email to the address on the account so contractors can stop sending the link out and can ask for their data.
No warranty
Construction Quote is provided as it is, without warranties of any kind, whether express or implied. We do not warrant that it will be uninterrupted, error free, or that a video will always upload successfully over a mobile connection.
Some consumer protection laws give you rights that cannot be excluded. Nothing here takes those away.
Limitation of liability
To the extent the law allows, Construction Quote and the people who run it are not liable for lost profits, lost business, lost or corrupted data, a job you did not win, a job you did win and regretted, or any indirect or consequential loss arising from using the service.
To the extent the law allows, our total liability to you for any claim connected with the service is limited to the amount you have paid us in the twelve months before the claim. Since we do not currently charge anything, that amount is presently nil. We are telling you that plainly rather than hiding it in a clause.
Nothing in these terms limits liability for fraud, or for death or personal injury caused by negligence, where the law does not permit that limit.
Governing law
These terms are governed by the laws of the Province of Manitoba and the laws of Canada that apply in it. The courts of Manitoba have jurisdiction, though this does not remove any right you have to bring a claim where you live.
Changes to these terms
If we change these terms we will update this page and the date at the top. If a change matters, such as billing being switched on, we will say so directly rather than relying on you noticing a new date.
